When you join our Woods Boss Shadow Brewing program, you become more than a customer. Our goal is to get you fully-immersed in the brewing experience, from beginning to end, so next time you're sitting at our bar you can say

RELEASE AND WAIVER OF LIABILITY
This Release and Waiver of Liability (the “Release”) releases Woods Boss Brewing Company, a Colorado limited liability company, and each of its each of its members, officers, directors, employees, volunteers, and agents (collectively “Woods Boss”).
Participant desires to participate in certain activities at Woods Boss wherein Participant will learn the brewing process and be able to participate in that process (the “Activities”) alongside Woods Boss employees.
Acknowledgement of Risk
I, the Participant hereby agree and acknowledge that the brewing process and its related activities are potentially hazardous activities, and can possibly result in serious bodily injury or death. I acknowledge that my engaging in the Activities subjects me to risks, both known and unknown. Those risks include, but are not limited to the inherent risks of the brewing process, the inherent risks of work with and heavy equipment and hot liquids, as well as to other risks and dangers, including acts of God, the forces of nature, the negligent and reckless acts or omissions of others or of Woods Boss, its officers, agents, directors and shareholders, members, managers, partners, employees, subcontractors or independent instructors (herein “Risks”). I further acknowledge that the above list is not exhaustive of all possible risks associated with the Activities, and that the above list in no way limits the extent or reach of this Release. I further acknowledge that participation in the Activities as provided by Woods Boss may include the use of other equipment that may increase the Risks. I further acknowledge and agree that my participation in the Activities may be unsupervised at any or all times. I agree that use of the facilities and equipment in connection with my relationship with Woods Boss will be in accordance with all rules and regulations of Woods Boss, as well as directions and instructions given by the instructors, employees and director of Woods Boss, or any other designated person.
WAIVER and RELEASE
I, the Participant, RELEASE AND FOREVER DISCHARGE AND HOLD HARMLESS WOODS BOSS AND ITS SUCCESSORS AND ASSIGNS, FOR AND FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, WHICH ARISE OR MAY HEREAFTER ARISE FROM MY PARTICIPATION IN THE ACTIVIES.
I, the Participant, recognize that any activities or services which I perform are done to provide me with education on the brewing process, and that my participation in the activities in no way established any employer employee relationship, independent contractor relationship, or any relationship other than a volunteer, or any liability to me from Woods Boss for any compensation.
I, the Participant, understand and acknowledge that this Release discharges Woods Boss from any liability, claim, or demand that I may have against Woods Boss with respect to bodily injury, personal injury, illness, death, or property damage that may result from my participation in the Activities, whether caused by the negligence of Woods Boss or otherwise.
I, the Participant, certify that I am in good physical condition and have no known disabilities that might otherwise be detrimental to my health or well-being or the health or well-being of other participants. As a Participant, I HEREBY EXPRESSLY ASSUME THE RISK OF INJURY OR HARM FROM THESE ACTIVITIES AND RELEASE, FOREVER DISCHARGE, AND HOLD HARMLESS WOODS BOSS FROM ANY AND ALL LIABILITY, CLAIMS, OR DEMANDS FOR INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE RESULTING FROM MY PARTICIAPTION IN THE ACTIVITIES. I FURTHER AGREE TO INDEMNIFY WOODS BOSS FOR ANY AND ALL LOSSES OR LIABILITIES ARISING OUT OF OR RESULTING FROM MY PARTICIPATION IN THE ACTIVITIES.
I, the Participant, hereby release and forever discharge Woods Boss from any claim whatsoever with arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my participation in the Activities. I have been advised that I am expected and encouraged to carry personal health insurance prior to participating in the Activities.
As a Participant, I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Colorado, and this Release shall be governed by and interpreted in accordance with the laws of the State of Colorado. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.
The terms of this contract shall serve as a complete release and EXPRESS assumption of all risks by Participant. I shall be solely responsible for my own safety and well-being, and for all expenses that arise directly or indirectly from my participation in the Activities.
By signing below, I express my understanding and intent to enter into this Release willingly and voluntarily.
IN WITNESS WHEREOF, Participant has executed this Release as of the date first written above.
